Advising the board directors of a PLC on the media and litigation issues arising from a claim for the return of over US$70m of bribes paid by an employee who had systematically bribed a client’s management team, in a foreign State owned business, to secure very lucrative business over a number of years. Including advising on and liaising with the FCA and SFO.

Overseas Group Board re suing former CEO of its UK subsidiary

Advising the UK and overseas Group boards of directors on the risk and media issues arsing from the discovery that the CEO of a the UK operating subsidiary, with the connivance of other directors and employees, had been awarding contracts at favourable prices to suppliers he secretly owned. Including strategic advice on running civil proceedings and a private prosecution at the same time.

Advising the directors of a service company the victim of a complex unlawful means conspiracy in a civil claim for £130m against previous former directors and the company’s legal advisers. Including strategic advice related to a criminal prosecution for contempt proceedings for perjury, the conduct of civil claims and the resolution of the civil claims by mediation.

Property Developer re mediation negotiation strategy

Consulting at short notice with a legal team representing a developer in connection with preparation for a mediation of a dispute concerning rights to light that was threatening to halt a critically important office development project in the City of London, including designing a negotiation strategy and assisting with the implementation of that strategy during the mediation which concluded with a comprehensive settlement.

IT Supplier re third party funding litigation

In connection with a claim for £30m related to a failed IT supply contract, advising on different third party funding models, which funders to approach, fee arrangements with the claimant’s own lawyers and what documents to produce to support the negotiation of terms.

Advising a property investment company in relation to two potential international arbitrations in Russia and Sweden with different arbitral institutions arising out of a dispute concerning a complex chain of inter-connected corporate transactions, advising on strategy to reduce the risk of escalation involving designing and implementing a negotiation strategy.

Advising a Government Department on the defence of a claim for US$1.6bn relating to an alleged misappropriation of an investment, including conducting the advocacy on the issue of quantum in an international arbitration.

Advising a holding company on the management of a subsidiary’s claim for £640m arising from alleged breaches of warranty and fraudulent misrepresentation in relation to a corporate acquisition.
